20899 1 ORDINANCE NO. 20,899 2 3 AN ORDINANCE AMENDING CHAPTER 36, SECTION 4 36-203.(g) OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE 5 ROCK, ARKANSAS TO EXTEND THE SUNSET PROVISION AN 6 ADDITIONAL FIVE (5) YEARS TO JULY 19, 2019 FOR PORTABLE 7 CLASSROOM BUILDINGS USED BY THE LITTLE ROCK SCHOOL 8 DISTRICT; AND FOR OTHER PURPOSES. 9 10 WHEREAS, portable classroom buildings were determined to require a Conditional Use Permit on 11 residentially-zoned Little Rock School District properties after passage of the current Zoning Ordinance; 12 and 13 WHEREAS,Ordinance No. 15,710 was passed by the Little Rock School Board of Directors on July 14 18, 1989,which allowed staff approval for placement of portable classroom buildings on Little Rock School 15 District campuses with a five (5)-year sunset provision; and 16 WHEREAS,that sunset provision has been extended by four(4) successive five(5)-year periods and 17 is to expire on July 19, 2014; and 18 WHEREAS,the Little Rock School District has employed a consulting team which has been charged 19 with the task of creating scenarios to include reassignment of students and/or construction of additional 20 classroom space and schools to accommodate the District's desire to eliminate portable classroom buildings 21 from District campuses. 22 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 23 OF LITTLE ROCK,ARKANSAS. 24 SECTION 1. That Chapter 36, Section 36-203.(g) of the Code of Ordinances of the City of Little 25 Rock,Arkansas, is hereby amended to read as follows: 26 (g)Sunset provision. The Board of Directors hereby extends the sunset provision of the Zoning 27 Ordinance an additional five(5)years to July 19,2019, for portable school classrooms in the Little 28 Rock School District. 29 SECTION 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 30 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 31 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect 32 as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. 33 SECTION 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent 34 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
