13893 1 RESOLUTION NO. 13,893 2 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO. 4 13,357 (JULY 17, 2012), TO CONTINUE THE APPOINTMENT OF 5 COMMISSIONERS FOR THE CAPITOL LAKES SEWER PROPERTY 6 OWNERS IMPROVEMENT DISTRICT NO. 148 UNTIL OWNERS OF 7 PROPERTY WITHIN THE DISTRICT CAN BE APPOINTED; AND FOR 8 OTHER PURPOSES. 9 10 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 13,537 (July 17, 2012) ("LRR 13,537"), 11 temporary Commissioners were appointed to conduct the ministerial business affairs of the Capitol Lakes 12 Sewer Property Owners Improvement District No. 148 because no owners of property within the District 13 were willing to serve, and business had to be conducted because of outstanding bond issues; and, 14 WHEREAS, the appointment in LRR 13,537 were for forty-five (45) days only; however, it is 15 necessary to make new appointments to conduct such ministerial business; and, 16 WHEREAS, the Board of Directors of the City of Little Rock wishes to appoint property owners as 17 Commissioners as soon as possible,but does not wish to delay the business of the District, 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK,ARKANSAS: 20 Section 1. Section 2 of LRR 13,357 is hereby amended to read as follows: 21 These appointments are made under special circumstances and shall remain valid in order 22 to conduct the business of the district,provided that as soon as practicable after a property 23 owner in the district agrees to serve as a Commissioner, the Commissioners appointed 24 pursuant to this resolution shall notify the Board of Directors and a resolution shall be 25 proposed to make such an appointment. 26 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 30 resolution. 31 Section 3. Repealer.
