20874 1 ORDINANCE NO. 20,874 2 3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDDING AND 4 AUTHORIZE THE CITY MANAGER TO ENTER INTO CONTRACTS 5 WITH REDSTONE CONSTRUCTION GROUP, INC., AND CONTECH 6 CONSTRUCTION PRODUCTS FOR EMERGENCY REPAIRS TO 7 COLLAPSED PIPE ON SWAGGERTY BRANCH, LOCATED SOUTH 8 AND EAST OF ROOSEVELT ROAD AND DR. MARTIN LUTHER KING, 9 JR. DRIVE; TO DECLARE AN EMERGENCY; AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, the Public Works Department has determined that two (2) very old nine (9)-foot 13 diameter storm sewer drains located on easement property south of Roosevelt Road, east of Dr. Martin 14 Luther King, Jr. Drive on Swaggerty Branch, have failed and are in danger of collapsing, potentially 15 causing serious flooding; and, 16 WHEREAS, a sink hole has developed in the area of the failed drains in between two (2) buildings 17 that currently house small businesses and further erosion could result in danger to the buildings and 18 businesses; and 19 WHEREAS, quick action is needed to avert further trouble with the drains; and, 20 WHEREAS, due to the emergency nature of the work, Public Works sought written quotes rather 21 than bids from four (4) local contractors deemed qualified and capable to perform this type of work in a 22 short time frame, and Redstone Construction Group, Inc., submitted the lowest responsive, responsible 23 quote meeting specifications of three (3) received for the project, said quote being in the total amount of 24 Two Hundred Twenty-Six Thousand, Seven Hundred Thirty-Four Dollars ($226,734.00), consisting of 25 One Hundred Eighty-Six Thousand Dollars for Redstone Construction Group ($186,000.00); (One 26 Hundred Fifty-Five Thousand Dollars ($155,000.00), plus 20% contingencies), and Forty Thousand, 27 Seven Hundred Thirty-Four Dollars ($40,734.00); (Thirty-Three Thousand, Nine Hundred Forty-Five 28 Dollars ($33,945.00), plus 20% contingencies), for Contech Construction Products for purchase of pipe 29 and appurtenances; and, 30 WHEREAS, the Board of Directors has determined that due to the existing emergency, the City 31 should dispense with competitive bidding and award contracts to Redstone Construction Group, Inc., and 32 Contech Construction Products to accomplish the necessary excavation and drain replacement work as 33 expeditiously as possible. [Page 1 of 2l 1 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 2 OF LITTLE ROCK,ARKANSAS: 3 Section 1. The Board of Directors hereby authorizes the City Manager to enter into contracts, in a 4 form acceptable to the City Attorney, in the total amount of Two Hundred Twenty-Six Thousand, Seven 5 Hundred Thirty-Four Dollars ($226,734.00), consisting of One Hundred Eighty-Six Thousand Dollars 6 ($186,000; (One Hundred Fifty-Five Thousand Dollars ($155,000.00) plus 20% contingencies) to 7 Redstone Construction Group, Inc., and Forty Thousand, Seven Hundred Thirty-Four Dollars 8 ($40,734.00); (Thirty-Three Thousand, Nine Hundred Forty-Five Dollars ($33,945.00) plus 20% 9 contingencies) to Contech Construction Products, to expeditiously perform the excavation work to re- 10 move the failed drains and to install new storm sewer drains. 11 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 12 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adju- 13 dication shall not affect the remaining portions of the ordinance, which shall remain in full force and 14 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 15 ordinance. 16 Section 3. Repealer. All ordinances and resolutions and parts thereof that are in conflict with any 17 provision of this ordinance are hereby repealed to the extent of such conflict. 18 Section 4. Emergency.
