5720 RESOLUTION NO 5,720 A RESOLUTION PERTAINING TO THE STATUTORY LEGISLATION GOVERNING THE METHOD BY WHICH DIRECTORS OF A CITY WITH MANAGEMENT FORM OF GOVERNMENT ARE ELECTED; AND FOR OTHER PURPOSES WHEREAS , the news media recently reported the filing of litigation in the Federal District Court attacking the constitutionality of the method utilized in the City of Little Rock to elect members of the Board of Directors, Little Rock having a city management form of government; and, WHEREAS, it is believed that Act 99 , Acts of Arkansas of 1921, as amended, same being the statutory authority providing that members of the Board of Directors in cities with management form of government in Arkansas shall be elected at large, is constitutionally valid as written and as applied in this City; and WHEREAS, it is found and determined that the at large method for electing directors in the City of Little Rock has served the entire community well, representing all citizens equally and fairly and that said method should be retained and the lawsuit herein referred to attacking the constitutionality of said method be vigorously defended. NOW THEREFORE , BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS . SECTION 1. The Board of Directors of the City of Little Rock strongly believes that the at large method for electing directors in cities with management form of government as provided by state law is the most effective and efficient method by which local government can serve all its citizens and that this method is constitutionally valid. SECTION 2 . The City of Little Rock will vigorously defend the Federal Court action herein referred to attacking the constitutionality of the statutory method for electing directors to the city government in Little Rock, Arkansas SECTION 3 . This Resolution shall be in full force and effect from and after its adoption. ADOPTED: May 17, 1977 ATTEST: APPROVED: Mayor
