3367 . { . t RESOLUTION NO. 3,367 A RESOLUTION ACCEPTING THE BID OF GENERAL MOTORS CORPORATION FOR THIRTY (30) THIRTY-FIVE-PASSENGER (35-PASSENGER) COACHES AND TWELVE (12) FORTY-FIVE- PASSENGER (45-PASSENGER) COACHES IN THE SUM OF EIGHT HUNDRED SEVENTY-NINE THOUSAND SEVEN HUNDRED FORTY-FOUR AND 84/100 DOLLARS ($379 ,744.84) ; AUTHORIZING PAYMENT THEREFOR; SPECIFYING CONDITIONS PERTAINING TO THE PAYMENT OF SAME; AND FOR OTHER PURPOSES. WHEREAS, the Housing and Home Financing Agency of the United States of America makes available to municipalities matching funds under the Urban Mass Transportation Act of 1964, also known as Public Law 88-365 , for acquisition of busses or motor coaches; and WHEREAS, Twin City Transit Company has agreed to make substantial financial contribution toward the acquisition of busses for use in the City of Little Rock, which, together with the funds provided by the said Housing and Home Finance Agency and the City of Little Rock will be sufficient to pro- cure thirty (30) thirty-five-passenger (35-passenger) busses and twelve (12) forty-five-passenger (45-passenger) busses; and WHEREAS, contingent upon approval of an application by the City of Little Rock for matching funds available through the Housing and Home Finance Agency, it is the desire of this Board of Directors to pursue without delay the acquisition of busses as aforesaid, it being understood by all persons that consunuuation of the purchase is and shall be contingent upon approval of said matching funds and payment of same by the Housing and Home Finance Agency; and -2- WHEREAS, advertisement of invitation to bid has been duly published and bids received pursuant thereto for thirty (30) thirty-five-passenger (35-passenger) and ten (10) forty-five- passenger (45-passenger) busses, all in accordance with the laws and procedures applicable to public bidding; and WHEREAS, the lowest responsible and responsive bid pursuant thereto was the bid of the General Motors Corporation (GMC Truck and Coach Division) for thirty (30) thirty-five-passenger (35- passenger) and ten (10) forty-five-passenger (45-passenger) busses; and WHEREAS, subsequent to the receipt of the said bid and by negotiation with the said low bidder the option is given to the City of Little Rock to purchase twelve (12) forty-five-passenger (45-passenger) busses in lieu of ten such busses, which, together with the base bid for thirty (30) thirty-five-passenger (35-pass- enger) busses adjusts the contract price to Eight Hundred Seventy- Nine Thousand, Seven Hundred Forty-Four and 84/100 Dollars ($879 ,744.84) which option the Board of Directors of the City of Little Rock desires to accept; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Subject to the conditions and restrictions set forth in Section 2 of this resolution the bid of General Motors Corporation (GMC Truck and Coach Division) in the aggregate sum of Eight Hundred Seventy-Nine Thousand, Seven Hundred Forty-Four and 84/100 Dollars ($879 ,744.84) for thirty (30) thirty-five- passenger (35-passenger) busses and twelve (12) forty-five-passenger -3- (45-passenger) busses, all in accordance with the specifications and other bidding documents, including, but not limited to, optional bid dated July 29, 1965, is hereby accepted. SECTION 2. The City Manager and Director of Finance are hereby authorized and directed to issue the necessary warrant or warrants of the City of Little Rock in payment of the purchase price as set forth in Section 1 hereof upon fulfillment of the following contingencies and conditions : (a) Receipt of Two Hundred Eighty-Seven, Three Hundred Seventy-Two and 42/100 Dollars ($287,372 .L1.2) by the City of Little Rock from the Housing and Home Finance Agency and commitment from said Agency of the sum of Ninety-Five Thousand, Seven Hundred Ninety and 81/100 Dollars ($95,790.81) upon completion of a traffic survey or study under the regulations of said Agency; and (b) That Twin City Transit Company pay to the City of Little Rock a contribution toward acquisition of said motor coaches in the sum of Three Hundred Five Thousand and No/100 Dollars ($305,000.00) ; and (c ) That the City of Little Rock and Twin City Transit Company reach full accord concerning the title, possession, lease, rental and other terms and conditions designed to protect the interest of the City of Little Rock in and to the said motor coaches .
