A RESOLUTION AWARDING CONTRACTS FOR PHASES
OF WORK IN CONNECTION WITH THE REMODELING
OF THE BOARD OF DIRECTORS ROOM IN CITY HALL;
AUTHORIZING THE EXECUTION OF CONTRACTS;
AUTHORIZING AND DIRECTING PAYMENT UPON COM-
PLETION OF THE WORK; AND FOR OTHER PURPOSES.
WHEREAS, certain work is necessary in connection with the
remodeling of the Board of Directors Room in City Hall, includ-
ing demolition, electrical, structural and mechanical, as the
terms are commonly used for construction purposes; and
WHEREAS, in connection with each of the aforesaid phases
of work, advertisement for bids was duly published under
specifications and plans on file in the Department of Community
Development in City Hall; and
WHE'_ EAS, pursuant to said advertisement, Fagan Air Con-
ditioning Co. , Inc. , was the sole bidder for the mechanical
work and no bids whatsoever were received in connection with
the demolition, electrical and structural work; and
WHEREAS, following the default of bidders in connection
with all of said work except for the bid of Fagan Air Condi-
tioning Co. , Inc. , contracts have been negotiated with various
contractors for the aforesaid segments of the work; and
WHEREAS, Burks Wrecking Company has agreed to perform the
demolition work for a consideration cf One Thousand Seven
Hundred Fifty and No/100 Dollars ($1,750.00) , Little Rock
Electric Company has agreed to perform the electrical work
for One Thousand Eight Hundred and No/100 Dollars ($1,800.00) ,
Arkansas Foundry Company has agreed to perform the structural
work for Five Thousand Nine Hundred Eighty-Six and 45/100
Dollars ($5,986.45) , and Fagan Air Conditioning Co. , Inc. , has
agreed to perform the mechanical work on a "Cost-plus-Fee" basis,
not to exceed Nine Thousand One Hundred Eleven and No/100 Dollars,
($9, 111.00) ; and

WHEREAS, it is the desire of the Board of Directors in
order to expedite and accomplish the work to award contracts
to the foregoing persons and companies in the designated sums;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. A contract is hereby awarded to Burks Wrecking
Company in the principal sum of One Thousand Seven Hundred Fifty
and No/100 Dollars ($1,750.00) for the demolition phase of the
work in connection with the remodeling of the Board of Directors
Room at City Hall in accordance with the plans and specifications
for the work on file in the Department of Community Development
and which are made a part of the contract documents.
SECTION 2. A contract is hereby awarded to Little Rock
Electric Company in the sum of One Thousand Eight Hundred and
No/100 Dollars ($1,800.00) for the electrical phase of the work
in connection with the remodeling of the Board of Directors Zoom
at City Hall in accordance with the plans and specifications for
the work on file in the Department of Community Development and
which are made a part of the contract documents.
SECTION 3. A contract is hereby awarded to Arkansas Foundry
Company in the principal sum of Five Thousand Nine Hundred
Eighty-Six and 45/100 Dollars ($5,986.45) for the structural
phase of the work in connection with the remodeling of the Board
of Directors Room at City Hall in accordance with the plans and
specifications for the work on file in the Department of Com-
munity Development and which are made a part of the contract
documents.
SECTION 4. A contract is hereby awarded to Fagan Air Con-
ditioning Co. , Inc. , for the consideration of Nine Thousand One
Hundred Eleven and No/100 Dollars ($9, 111.00) for the mechanical

phase of the work in connection with the remodeling of the Board
of Directors Room at City Hall in accordance with the plans and
specifications for the work on file in the Department of Com-
munity Development and which are made a part of the contract
documents.

SECTION 5. The City Manager is hereby authorized and
directed to execute for and in behalf of the City of Little
aock a contract with Burks Wrecking Company under and pur-
suant to Section 1 hereof, which contract shall be in form
and substance as follows:

Scope :
Furnish all necessary equipment , material , and labor
for the nrenaration and execution of the wrecking and
removal of salvable - nonsalvable items within the
general interior of Room 214 , City Hall and including
the related area of floor above .
General : Preparation and execution of demolition shall be in
workmanlike manner with all normal precautions under-
taken for the safety of human life and limb and damage
to any adjacent section of the City Hall structure or
grounds .
Normal inclement weather shall he construed as a
working day.
All salvable items shall be relocated as directed
by the project supervisor .
All non-salvable items indicated by project supervisor
shall he removed from the City Hall premises.
At the completion of wrecking and removal , the area
concerned shall be left broom clean with all items
that may have been moved to facilitate this work, to
he replaced in its original locations ; unless such
item is waived by project supervisor .
The sub-contractor shall carry insurance in sufficient
limits to protect all parties throughout the operation.
Necessary permits shall he procured and all existing
safety regulations complied with.
This phase of the project shall be considered satisfactorily complete
for payment on the signed statement of the project supervisor.

sheets entitled "Scope of Work Agreement", or some similar name,
and as more fully shown and described on the drawings entitled
"Remodeling of Board of Directors' Room" and the general conditions
pertaining to the work, all of which are on file in the office of
Community Development , City Hall , Little Rock, Arkansas, and are
incorporated as a part of this contract by reference as though set
out in full herein.
2. Time of Completion.

and other items necessary to complete the work .
5 . Changes in the Work.
The owner may order changes in the work, in which event the
contract sum shall be adjusted accordingly. All such orders and
adjustments shall be in writing.
6 . Insurance Requirements .
CONTRACTOR shall maintain public liability insurance in limits
acceptable to the City Manager and shall further maintain Workmans'
Compensation Insurance covering contractors ' employees at all times
during performance of the work .
7. Liens Prior to Final Payment and After Completion of the Work.
Contractor shall make affidavit that all labor and materials
for which a lien could be filed have been paid in full and that
there are no unpaid claims which may ripen into a lien.
8. City Manager Status .
The City Manager is designated the Agent of the owner for the
purposes of this contract and the work shall be prosecuted to his
entire satisfaction provided, however, that final acceptance of the
work by the City Manager for the owner shall not be arbitrarily with-
held.

All material , parts , fittings , and equipment shall be
new and as specified as to quality as per drawing.
Where miscellaneous items are not noted , they shall
conform to the accepted standard of the trade .
Conditions : Work shall be undertaken in consideration of project
work schedule and in co-operation with other trades
to facilitate project completion.
All conductors shall be #12 RHW minimum unless noted
otherwise .
Provide all miscellaneous material.
Minor detail not shown or specified shall be included
in this work.
Without extra charge , relocate work to prevent conflict
of work with other trades .
This work shall include required conduit runs , connect
to outlets and speaker back boxes , and stub-offs for
sound system (back-boxes furnished by others ).

Conditions : No change to plan or specification shall be made with-
out written approval of project supervisor although
not noted on drawing or specified , all required runs ,
connections , and related fittings shall be made to
assure the proper operation of the system as well as
the proper operation ion of main system tie-in.
All circuits to be labeled and identified at panel
and/or main breakers.
Test of system to be made prior to final approval.
_ Electrical contractor shall furnish a written guarantee
of labor-free replacement or repair of defective mat-
erial , equipment , or parts for a period of one (l) year
from and after the date of final approval or acceptance
of the work by the project supervisor.
Also included a warrenty of replacement for defective
and short-lived lamps.
All damage or loss to materials , equipment , parts
during period of construction shall he replaced by
electrical contractor without extra charge .
Obtain all licenses and permits .

This phase of project shall be considered satisfact-

AGREEMENT
Scope : Furnish all material , equipment , and labor necessary
for the erection of 3rd floor joist system and steel
stairways as shown on AFCO shop drawing F-1 , quotation
May 18th, 1965, and specified herein.
General : Work shall be by qualified craftsmen of the trade and
conform to all accepted standards of the trade.
Conditions : Structural contractor shall be responsible for accuracy
of design and erection of floor structure and stairs ,
errect work to correct lines and levels , plumb , square ,
and firmly secured in place.
Provide necessary supporting members , anchors , sleeves ,
clips , and other items to insure proper installation.
Upon completion of work, area shall be cleared of loose
material.
Insurance shall be carried of sufficient limits to
protect all parties concerned .
Procure necessary permits.
Pay all fees and taxes .
This phase of the project shall be considered satisfactorily complete
for payment on the signed statement of the project supervisor.

with Fagan Electric Company, Inc. , under and pursuant to Section 4
hereof, which contract shall be in form and substance as follows:

OWNER, and Fagan Air Conditioning Company, Incorporated hereafter
celled CONTRACTOR,
WITNESS:
That the owner and contractor, for the considerations hereafter
set forth, agrees as follows:
I . Scope of Work.
The CONTRACTOR shall furnish all of the material and perform
all of thA cork for the project described on the attached sheet or
sheets entitled "Scope of Work Agreement", or some similar name,
and as more fully shown and described on the drawings entitled
"Remodeling of Board of Directors' Room" and the general conditions
pertaining to the work, all of which are on file in the office of
Community Development, City Hall , little Rock, Arkansas, and are
incorporated as a part of this contract by reference as though set
out in full herein.
2. Time of Completion.
The work shall be commenced with 7 days from issuance of a
work order and shall be substantially completed on or before 60
calendar days thereafter, or in accordance with the work schedule
constituting a part of the plans and specifications of the work .
3. Contract Sum.
The owner shall pay the CONTRACTOR for the performance of the
contract a sum equal to the actual cost of labor and materials
employed in the work together with a fee equal to 21% of said
actual cost, provided that in no event shall the payment to
CONTRACTOR exceed the sum of $9, 111 .00, Payment shall be within
seven (7) days after satisfactory completion of the work, provided
that such payment be made to the extent of 90% upon completion and
acceptance of the work by OWNER and the remaining 10% retained by
OWNER shall be paid upon completion of the whole project and
acceptance thereof by OWNER.

SPECIFICATIONS: MECHANICAL
SCOPE OF CONTRACT AGREEMENT
SCOPE : Furnish equipment , material , and labor necessary to
install air conditioning system as shown on drawing
and specified herein.
GENERAL: Work shall be by qualified craftsmen and conform to
the accepted standards of the trade , state , and local
regulations that may apply.
All material, equipment , and parts shall be new,
CONDITIONS : Shop drawings must be submitted showing required
piping , controls, electrical wiring , and circulating
pumps in order to tie three (3) trans , type B , unit
ventilators #830 to existing heating and chiller system.
Work shall be undertaken in consideration of project
work schedule and in co-operation with other trades
to facilitate project completion.
Existing air conditioning unit to be relocated and
reconnected to serve old Court Room at first floor.
Obtain all necessary permits.
Pay all fees and taxes.
All defective work or material shall be replaced and
inspection and tests repeated .
All repairs to pipe shall be with new material.
Mechanical contractor shall replace any material or
part pertaining to this section that may be damaged
or lost during construction and without extra charge.
CONDITIONS : The mechanical contractor shall not allow his waste
(cont. ) material to accumulate in or about the premises.
Proper cleaning precaution shall be undertaken during
and at the completion of this work. Any stoppage,
discoloration or damage to parts of the building, its
finish, or furnishings due to the mechanical contractor's
failure to properly clean the mechanical system, shall
be repaired by him without extra charge.
Patch-up and painting shall be by others.
The mechanical contractor shall furnish a written guarantee
of all mechanical materials , equipment , and labor to be
free of defects for one ( 1) year from date of final
approval and shall further guarantee to replace or repair
without charge any defect that may occur during this period.
This phase cf project shall be considered satisfactorily complete for
payment on the signed statement of the project supervisor.

SECTION 9. The City Manager and Director of Finance are
hereby authorized and directed upon acceptance of the work in
each of the foregoing contracts to issue the necessary warrant
or warrants in payment of the contract prices according to the
terms of the respective instruments.
SECTION 10. This resolution shall be in full force and
effect from and after its adoption.
