13692 1 RESOLUTION NO. 13,692 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH SCOTT EQUIPMENT COMPANY IN THE 5 AMOUNT OF ONE HUNDRED SITXY-SEVEN THOUSAND, SIX 6 HUNDRED DOLLARS ($167,600.00) FOR THE PURCHASE OF TWO (2) 7 BACKHOES FOR THE PUBLIC WORKS DEPARTMENT, UTILIZING 8 THE HOUSTON-GALVESTON AREA COUNCIL COOPERATIVE 9 CONTRACT; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the Public Works Department needs to replace two (2) 1997 model backhoes that 12 require replacement due to their age, condition, and excessive repair and maintenance costs; and, 13 WHEREAS, the staff recommends the purchase of two (2) backhoes at a cost of Eighty-Three 14 Thousand, Eight Hundred Dollars ($83,800.00) each for the total amount of One Hundred Sixty-Seven 15 Thousand, Six Hundred Dollars ($167,600.00), utilizing the Houston-Galveston Area Council 16 Cooperative Contract,which will provide the optimal pricing and delivery options for this purchase; 17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a contract with 20 Scott Equipment Company, utilizing the Houston-Galveston Area Council Cooperative Contract, for the 21 purchase of two (2) backhoes at a cost of Eighty-Three Thousand, Eight Hundred Dollars ($83,800.00) 22 each for a total of One Hundred Sixty-Seven Thousand, Six Hundred Dollars ($167,600.00)to be used by 23 the Public Works Department. 24 Section 2. Funds for this purchase are allocated in the 2012 3/8-Cent Capital and 5/8-Cent 25 Operational Improvements Sales Tax Funding. 26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 30 resolution. 31 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent 32 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
