RESOLUTION NO. 2,967
A RESOLUTION GRANTING THE COMMONWEALTH FEDERAL SAVINGS & LOAN
ASSOCIATION THE PRIVILEGE TO USE CERTAIN SPACE UNDERNEATH THE
EXISTING SIDEWALK ADJACENT TO LOTS 7 & 8, BLOCK 103 OF THE ORIGI-
NAL CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES .
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. Commonwealth Federal Savings & Loan Association
is hereby granted the privilege to excavate and use certain space under
the existing sidewalk adjacent to Lots 7 and 8 , Block 103 of the Origi-
nal City of Little Rock, Arkansas, for use as basement parking. The
property to be used for such purposes is described as follows :
Beginning at a point on the southern boundary of Lot No . 7 ,
Block 103, original city of Little Rock, Arkansas , forty (40)
feet east of an iron pipe at the southwest corner of Lot No .
7 , hereinafter referred to; Running thence easterly along said
southern boundary line of Lot 7 , one hundred (100) feet to an
iron pipe at the southeast corner of Lot No. 7 ; Thence at
right angles northerly along the eastern boundary of Lot 7
and the eastern boundary of Lot No. 3, eighty-seven (37) feet
to a point thirteen (13) feet south of an iron pipe at the
northeast corner of Lot No . 8; Thence at right angles easterly,
twelve (12) feet to the face of the western curb of Spring
Street; Thence at right angles southerly, eighty-seven (87)
feet to a point twelve (12) feet east of an iron pipe at the
southeast corner of Lot No . 7; Thence along the circumference
of a circle or radius of twelve (12) to a point twelve (12)
feet south of an iron pipe at the southeast corner of Lot No .
7 and on the face of the northern curb of Lest Seventh Street;
Thence one hundred (100) feet westerly, along the face of the
northern curb of West Seventh Street; thence, at right angles
northerly to the point of beginning.
A plat and drawing of the area prepared by Ginocchio, Cromwell, Carter &
Neyland, Architects, dated December 6, 1962, has been filed with the
Department of Community Development of the City of Little Rock, Arkansas .
SECTION 2. This franchise shall extend only to such area as
exists under the said existing sidewalk and said franchise shall not be
construed to permit any interference by franchisees with existing utility
facilities located under or near the said sidewalk. It shall be a condi-
tion upon this franchise that gas utilities be given an above ground meter
location outside the building and no unmetered service line to the meter

location shall pass through the building, including underground space
granted herein.
SECTION 3 . The excavation, the construction of lateral and
overhead supports and all phases of the alterations of the area under
the existing sidewalk shall be controlled and governed by the appro-
priate ordinances of the City of Little Rock and subject to the in-
spection and approval of the Director of the Department of Community
Development of the City of Little Rock.
SECTION 4. The Commonwealth Federal Savings & Loan Associa-
tion as a condition upon this grant and privilege shall assume primary
liability to the public for any damage sustained by the public resulting
from the construction or use of the property above described.
SECTION 5 . The City of Little Rock retains the right to re-
voke this franchise in whole or in part at any time that the above
described property is needed for public purposes and the Commonwealth
Federal Savings & Loan Association shall be required to restore the
above described property to its condition prior to excavation and to
fill said excavated space to such level as may be required by the City
of Little Rock and shall further be required topay all costs attendant
to the restoration and filling of the excavated space described above.
SECTION 6 . This resolution shall be in full force and effect
from and after its adoption.
