A RESOLUTION ACCEPTING THE LOW BID OF JAMES H. CONE, INCORPORATED,
IN THE AMOUNT OF EIGHTY TWO THOUSAND EIGHT HUNDRED AND NO/100
DOLLARS ($82,800.00)FOR THE CONSTRUCTION OF A FIRE STATION AT
9TH AND SHERMAN STREETS IN THE CITY OF LITTLE ROCK; AUTHORIZING
AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO AND EXECUTE
AN AGREEMENT ON BEHALF OF THE CITY OF LITTLE ROCK, ARKANSAS,
WITH THE SAID JAMES H. CONE, INCORPORATED, FOR THE SAID CONSTRUC-
TION; AND FOR OTHER PURPOSES.
WHEREAS, invitation for bids for the construction of a Fire
Station at 9th and Sherman Streets in the City of Little Rock has been
legally published; and
WHEREAS, bids have been received and opened pursuant to said
advertisement; and
WHEREAS, the bid of James H. Cone, Incorporated, is the lowest
bid submitted therefor; and
WHEREAS, the City of Little Rock desires to award the contract
for the said construction to said James H. Cone, Incorporated;
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROOK, ARKANSAS:
SECTION 1. The low bid of James H. Cone, Incorporated in the
amount of Eighty Two Thousand Eight Hundred and No/100 Dollars
($82,800.00) for the construction of a Fire Station at 9th and Sherman.
Streets in the City of Little Rock is hereby accepted.
SECTION 2. The Mayor and City Clerk are hereby authorized and
directed to enter into and execute an Agreement on behalf of the City of
0 Little Rock, Arkansas, with James H. Cone, Incorporated, for the said
construction, which Agreement shall be in form and words as follows:
CONSTRUCTION AGREEMENT
THIS AGREEMENT, entered into this day of August, 1959 ,
by and between JAMES H. CONE, INC. , a corporation operating under
the laws of the State of Arkansas, with offices at 915 West Second
Street, Little Rock, Arkansas, hereinafter called the "Contractor"
and the CITY OF LITTLE ROCK, ARKANSAS, hereinafter called the "Owner",
WITNESSETH that the Contractor and the Owner, in consideration of
Premises and of the mutual covenants, considerations and agreements
herein contained, agree as follows:
STATEMENT OF WORK. The Contractor shall furnish all labor and
materials and perform all work for the construction of a Fire Station,
complete, including General Construction, Electrical Work, Plumbing,
Heating and Air Conditioning as specified except omitting sodding and
planting as set forth under Alternate "A" of the specifications, in
strict accordance with the specifications dated May 25 , 1959 , entitled
"A Fire Station for the City of Little Rock, Arkansas, Ninth and Sher-
man Streets, Little Rock, Arkansas, Trapp, Clippard and Phelps, Archi-
tects" , Addendum No. 1 thereto dated July 27, 1959 and Addendum No. 2
thereto dated July 29 , 1959 ; and the drawings listed therein; all of
which are made a part hereof.
TIME FOR COMPLETION. The work shall be commenced on a date to be
specified in a written order of the Owner and shall be completed within
180 calendar days from and after said date as specified herein in Para-
graph 2-19 of the General Conditions.
COMPENSATION TO BE PAID TO CONTRACTOR. The Owner will pay and the
Contractor will accept in full consideration for the performance of
the Contract, subject to additions and deductions as provided therein,
the sum of EIGHTY TWO THOUSAND EIGHT HUNDRED Dollars and NO Cents,
($82,800.00) , being the amount of the Contractor' s Base Bid of $84,300.00
less $1,500.00 deduction for accepting Alternate "A" .
IN WITNESS WHEREOF, the Parties hereto on the day and year first
above written have executed this agreement in counterparts, each of
which shall, without proof or accounting for the other counterparts,
be deemed an original thereof.
