53901; a� C "`.,t ORDINANCE NO. 5390 , AN CR DINANCE REQUIRING THE TESTING FOR BA.NGIS DISEASE OF ALL CATTLE FROM WHICH MILK USED IN ALL GRADE "A" AND "B't DAIRIES IS SECURED, WHERE SUCH MILK OR ANY PORTION THERS- OF IS CONSUMED, OR OFRERED FOR CONSUMPTION, IN THE CITY OF LITTLE ROCK, ARKANSAS; PROVIDING A PENALTY FOR THE VIOLL*- TION HEREOF; AND FOR OTHER PURPOSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS SECTION 1. That from and after six (6) months from date of the passage and approval of this ordinance all cattle in all herds supplying milk to be consumed, or offered for s ale, within the City of Little Rock., shall be tested for Bangle disease and it shall be unlawful to sell, or offer for sale, any milk in the City of Little Rock which is secured from a cow or cows which have not been so tested and certified to as being free frop said disease. A earti- ficate signed by the Veterinarian in duplicate shall be the only valid evidence of a compliance herewith. One copy of such certificate shall be filed with the City Health Officer and the duplicate shall be kept, at all times, by the owner of the cow or cows-covered by the certificate. SECTION 2. 0aid test for Bangle disease shall be made only by persons, and in laboratories having the written approval of the City Health Officer of the City of Little Rock. The technique used in the Field and in the laboratory in making said test shall also be approved by the City Health Officer and the determination of reactors shall be the same as used by the State Livestock Sans- 9044V taryA and the United States. Bureau of Animal Industry. SECTION 3. All herds in which reactors or suspects are found shall be retested every sixty (60) days until'they have passed two (2) negative tests; then retested in ninety (90) days; then re- tested'in one - hundred- eighty (180) days; and annually thereafter. All owners of herds an ninety (90) day teats, one- hundre,d- eighty (18Q) day tests, or annual tests shall IvAwdWy notify the Health Officer of any abortions in their herd. All additions to herds must be, in accordance with State. and Federal requirements covering same. j,,k -2- SECTION 4. All reactors and suspects shall be removed immediately from the milking herd and the milk from reactors and suspects shall not come into contact with any equipment used in the handling, processing or storing of tirade "A* or "B" raw or pasteu- rized milk. All- reactor& shall be branded with a 81B* on the Jaw and shall be disposed of in accordance with the current requir4mente f. apprbVed by the United Statea Bureau of Animal Industry. No milk, nream or skin milk from reactors or suspects shall be used for any purpose. The.Health Officer or the City veterinarian shall have the power .td order any reactor or suspect separated from any herd and hehd under such rules and regulations as said officers may deem boat until proper tests definitely establish the condition of the animal. SECTION 5. Immediately after the removal of the re- actor or react: ore,, the premises shall be thoroughly cleaned and dis- infected under the supervision of the City Health Officer, a repro sentative of the State Uvaatock Sanitary Authority or the UhZ ad States Burea% of Animal Industry. SECTION H. Any person, firm or corporation violating- any provision of this ordinance, or violating any reasonable regu- lation or rule imposed hereunder by the City Health Officer, shall be deemed guilty of a misdemeanor and upon conviction shall be fined in any sum not less than Twenty -Five ( #25.00) Dollars nor more than Five Hundred (4500.00) Dollars and each violation shall constitute a separate offense.
