NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Section 2.1 entitled ELIGIBLE EMPLOYEES OF EXHIBIT A to Resolution 6,482, shall be amended to read as follows: Section 2.1 Eligible Employees All permanent non - uniformed employees of the City of Little Rock under the administrative control of the City Manager shall be eligible. The employees of any other agency receiving funds under the statutory authority of the Little Rock Board of Directors and the employees of any agency, commission, or authority created by the City of Little Rock pursuant to statutory authority to do so may be included upon approval of a petition to said Board of Directors. CARPENTER ASSISTANT CITY ATTORNEY City Hall Markham at Broadway Little Flock, Arkansas 72201 501/371 -4527 10 4 EXTENSION OF NON - UNIFORMED EMPLOYEES RETIREMENT PLAN TO EMPLOYEES OF THE LITTLE ROCK REGIONAL AIRPORT DATE: FEBRUARY 5, 1988 The City is currently negotiating a contract with the Little Rock Airport Commission to extend benefits of the non- uniformed employees retirement plan to Airport employees. In reviewing the contract we determined that the program is not available to the Airport employees under the terms as they are presently drafted. Resolution 6,482 (December 16, 1980) carefully defined eligible employees. For employees of outside agencies there is a requirement that the agency actually receive funds under the statutory authority of the Board of Directors. The Airport Commission does not directly receive funds from the City, and, therefore, its employees are not eligible for inclusion in this program. Under the AETNA contract, the Airport employees could have participated in the plan at its inception had they chosen to do so. However, because the Airport chose not to participate, it has waived its right of participation and now must have its application for membership approved by this Board. This amendment facilitates the ability of this Board to grant the petition. The resolution attached to this memorandum adds language to Section 2.1 of the current retirement plan that would extend coverage to the Airport and similar agencies that wish to join the City. The resolution amends Resolution 6,482 and Resolution 7,630 (July 15, 1986) which are the only two resolutions concerning the retirement plan that will be affected. M IN M M M M I have attached to this memorandum the resolution in a form to be approved and a copy of the resolution with the amending language in italics. Please, note that approval of the resolution does not automatically enroll the Airport into the retirement plan. A separate contract will have to be prepared to accomplish this purpose.
