116730 1 RESOLUTION NO. 11,673 3 3 A RESOLUTION AUTHORIZING THE EXECUTION OF AN 4 INTERLOCAL AGREEMENT BETWEEN THE CITY OF LITTLE 5 ROCK, AKANSAS AND THE CITY OF CONWAY, ARKANSAS, 6 GRANTING THE LITTLE ROCK AMBULANCE AUTHORITY 7 ( "LRAA ") D /B /A METROPOLITAN EMERGENCY MEDICAL 8 SERVICES ( "MEMS ") AN EXCLUSIVE FRANCHISE TO 9 PROVIDE AMBULANCE SERVICES TO THE CITY OF 10 CONWAY, ARKANSAS; AND FOR OTHER PURPOSES. 12 WHEREAS, the Little Rock Ambulance Authority d/b /a Metropolitan Emergency 13 Medical Services ( "MEMS ") has been awarded an exclusive franchise to provide 14 ambulances services to the City of Conway, and 15 WHEREAS, the Cities of Little Rock and Conway wish to enter into an interlocal 16 agreement to provide said ambulance service, as has been done with certain cities and 17 counties adjacent to Little Rock, and 18 WHEREAS, MEMS has represented to this Board that it has the capability and 19 resources to provide such service without increasing expenses, rates, or response times 20 for Little Rock citizens or other participating entities, and 21 WHEREAS, this Board believes that it is beneficial to have MEMS provide 22 ambulance services to the City of Conway and thereby promote the health and welfare 23 of the citizens of Little Rock and Conway, and [PAGE 1 of 3] Resolution Interlocal Agreement between the City of Little Rock, Arkansas and Conway 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, the delivery of ambulance services (emergency and non - emergency) to Conway will enhance MEMS' financial soundness and increase its ability to deliver high - quality emergency medical services to all citizens. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board hereby authorizes the Mayor to enter into a five (5) year interlocal agreement with the City of Conway, Arkansas, granting MEMS an exclusive franchise to provide ambulance services (emergency and non - emergency) to the City of Conway. Section 2. For purposes of this resolution, the term "ambulance services" shall include the transportation and care provided the critically ill or injured prior to arrival at a medical facility and within a medical facility subject to the individual approval of the medical staff and governing board of that facility, and further the transport to or from medical facilities including but not limited to hospitals, nursing homes, physician's offices, and other health care facilities, of persons who are infirm or injured and who are transported in a reclining position or who are ill but considered to be non - emergency in status and who request ambulance transportation. Section 3. Severability. In the event any portion of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this resolution, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this resolution. Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any provision of this resolution are hereby repealed to the extent of such conflict.
