A RESOLUTION TO DIRECT THE CITY ATTORNEY TO DRAFT ANY
NECESSARY ORDINANCE AMENDMENTS OR NEW ORDINANCES TO
ADDRESS THE VARIOUS QUESTIONS RELATED TO PLANNED UNIT
DEVELOPMENTS (PUD'S) IN THE CITY OF LITTLE ROCK INCLUDING BUT
NOT LIMITED TO THEIR EXPIRATION PROCESS, THE NUMBER OF
ALLOWED RENEWALS, THE SPECULATIVE ZONING NATURE OF SOME
PUD APPLICATIONS, AND FOR OTHER PURPOSES.
WHEREAS, The question of possible deficiencies in current City ordinances pertaining
to Planned Unit Developments (PUD's) was first raised on April 4, 2001, following
approval of the latest revision to the Summit mall application, and
WHEREAS, ensuing litigation was filed to invalidate the approval of the revised PUD
application, and
WHEREAS, the Sixth Circuit Court of Pulaski County ruled on June 5, 2002, that
among other things, this original application had indeed expired, and
WHEREAS, it is now deemed in the best interest of the City of Little Rock to address
and resolve the confusion surrounding various aspects of the existing ordinances related o
the Planned Unit Development application process.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The Little Rock Board of Directors herby directs the City Attorney to
review all current City ordinances pertaining to all forms of Planned Unit Developments,
and draft wither the necessary amendments to those ordinances or draft entirely new
ordinances that would at the very least:
a. Revise the current expiration procedure to eliminate the existing required
revocation hearing by the Little Rock Planning Commission.
b. Establish a firm expiration date as being two (2) years form the date a PUD
ordinance is passed by the Little Rock Board of Directors.
c. Limit the number of renewals to one two 92) year period, but requiring a
formal written request from the applicant for a renewal at least ninety (90)
days prior to the first annual expiration date.
d. Require that a building permit be obtained no later than thirty (30) days after
passage of a PUD ordinance or approval of the final plat, whichever occurs
last, and that construction begin no later than thirty (30) days thereafter.

e. Strengthen all enforcement mechanisms to correct any and all violations of
PUD ordinance conditions, including the immediate revocation of the
breached PUD ordinance if necessary.
f Insure that all amendment provisions are clear, unambiguous and consistent
with all other related City Ordinances.
Section 2. The City Attorney is further directed to prepare said amendments for
consideration by the little Rock Board of Directors no later than October 1, 2002, or
otherwise report back to the Little Rock Board of Directors in writing why that deadline
cannot be met.
Section 3. Repealer. All resolutions, policy statements, guidelines and parts of any such
documents are herby repealed to the extent that any inconsistency exists with the
provisions of this resolution.
