3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A
4 CONTRACT WITH WILLIS BAILEY AS PART OF THE TORNADO
5 DISASTER REBUILD TARGETED NEIGHBORHOOD ENHANCEMENT
6 PLAN TO RENOVATE A SINGLE FAMILY RESIDENCE AT 3405 SOUTH
7 BATTERY STREET IN THE APPROVED TORNADO DISASTER REBUILD
8 TNEP AREA.

10 WHEREAS, the City has been granted authority to contract with owners of property to
11 agree to live in residential dwellings in targeted neighborhoods for a period of five (5) years,
12 and to use the consideration for such agreements to construct or rehabilitate residential
13 structures in an effort to recapture or rehabilitate neighborhoods that have become urban blight,
14 or that could become an area of blight if such actions are not taken, and
15 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. Code Ann. ยงยง
16 14- 169 -1101 to 1108 (Michie Repl. 1998), as may be amended) (hereinafter referred to as "the
17 Act "), the City Board of Directors has completed the process and determined that this area in
18 the City qualifies as a targeted neighborhood as defined by the Act, and
19 WHEREAS, after fulfillment of the statutory requirements to do so, the City adopted
20 Little Rock, Ark., Ordinance No. 18,387 (November 14, 2000), and designated this portion of the
21 City as the Tornado Area Disaster Rebuild Targeted Neighborhood Enhancement Plan area
22 (hereinafter referred to as the "Tornado Area TNEP "), and
23 WHEREAS, the Owner, Willis Bailey, has submitted an appropriate application to
24 contract with the City to provide an owner occupied residential structure within the boundaries
25 of the Tornado Area TNEP in the amount of TWENTY THREE THOUSAND THREE
26 HUNDRED AND FIFTY -EIGHT DOLLARS ($23,358.00), and
27 WHEREAS, the City desires to contract with the Owner pursuant to the Tornado Area
28 TNEP program, and the Owner desires to assure the residency requirements of the TNEP

1 program are met so this neighborhood can be recaptured and a meaningful residential area can
2 be developed,
3 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
4 CITY OF LITTLE ROCK ARKANSAS:
5 Section 1. The City Manager is authorized to execute a contract with Willis Bailey for
6 the renovation of the residence at 3405 South Battery Street in the approved Tornado Area
7 TNEP.
8 Section 2. This action authorizes a $23,358.00 contract between the City of Little Rock
9 and Willis Bailey to support renovation activities at 3405 South Battery Street in the Tornado
10 Area TNEP.
11 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
12 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
13 declaration or adjudication shall not affect the remaining portions of the resolution which shall
14 remain in full force and effect as if the portion so declared or adjudged invalid or
15 unconstitutional was not originally a part of the resolution.
16 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
17 inconsistent with the provisions of this resolution are hereby repealed to the extent of such
18 inconsistency.
19 Section 5. This resolution shall be in full force and effect from and after its adoption.
