105811 RESOLUTION NO. 10,581 2711 2 3 A RESOLUTION TO AUTHORIZE AN AGREEMENT WITH THE 4 PULASKI COUNTY TRUANCY PROSECUTOR; AND FOR OTHER S PURPOSES. 6 7 8 9 to 11 12 13 14 is 16 17 18 19 20 21 22 23 24 2s 26 27 28 29 30 31 32 33 34 WHEREAS, state statute places upon local governments the responsibility to prosecute truant youths and families, and WHEREAS, in an effort to maximize the efficiency of this program the City has entered into an agreement with other local city attorneys and the prosecuting attorney to participate in a grant funded by the Department of Youth Services, and WHEREAS, it is time to renew this agreement for another year, NOW, TAFRF.FORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City Attorney is authorized to enter into an agreement, in substantially the same form as Attachment A to this resolution, with the Prosecutor of the Sixth Judicial District, and other city attorneys in the area, to handle the prosecution of truancy cases in the local juvenile courts. J. rick, ce =Mayor • ATTACBMENT A AMENDED AGREEMENT REGARDING 271 TRUANCY PROSECUTION FOR THE S/XTHJUDICIAL DISTRICT, STATE OFARKANSAS This Amended Agreement is entered into pursuant to ACA 6-18 -222, as amended by Act 1308 of 1997 (Section 1(a)(6)(A) and (c)). This Amendment is entered into and made by and between the Prosecutorial Authorities and the Juvenile Judges of the Sixth Judicial District to amend the Agreement Regarding Truancy Cases dated September 30, 1997, entered into and agreed upon by the parties based upon conditions which were never met. Thus, the parties have entered into and made this Amended Agreement this day herein. The Prosecutorial Authorities, as defined in Act 1308, Section 1(a)(8), include the following officials: (a) Larry Jegley, elected Prosecuting Attorney of the Sixth Judicial District, for schools of the unincorporated areas of the Sixth District or within cities not having a police or municipal court; (b) Thomas Carpenter, appointed City Attorney of the City of Little Rock, Arkansas, for schools located within the city limits and /or of the Little Rock School District; (c) Randall Morley, elected City Attorney of the City of North Little Rock, Arkansas, for schools located within the city limits and /or of the North Little Rock School District; (d) Robert Bamburg, elected City Attorney of the City of Jacksonville, Arkansas, for schools located within the city limits and /or of the Pulaski County Special School District within Jacksonville; (e) Stephen Cobb, elected City Attorney of the City of Sherwood, Arkansas, for schools located within the city limits and /or the Pulaski County Special School District within Sherwood; and, (f) Mark Stodola, appointed. City Attorney of the City of Maumelle, Arkansas, for schools located within the city limits and /or of the Pulaski County Special School District within Maumelle. The Municipal Attorneys enter into this Agreement to alleviate a serious problem with juvenile truancy, to further the goals of Act 1308, and to assist juveniles and families in need of supervision because of truancy. As such, the parties hereby agree to implementation of the following provisions: Amended Agreement for Truancy Prosecution Page 1 • 0 1. All truancy cues will be filed and adjudicated in the Sixth Judicial District Circuit /Chancery Court, Juvenile Divisions Seventh, Eighth, or Tenth. 2. To the extent that the undersigned parties have the authority pursuant to State law to prosecute petitions for truancy in Juvenile Court, the undersigned parties agree to the appointment by the Prosecutorial Authorities of Robert Bamburg, Attorney at Law, and /or his duly appointed representative(s), to file and pursue adjudication of all truancy cases for all schools throughout the Sixth Judicial District pursuant to the requirements of Act 1308, Section 1(a)(6)(A), and under the terms and conditions of Bamburg's Contract for Truancy Prosecution. 3. This Agreement is contingent upon receipt by Robert Bamburg of grant funds from the Department of Human Services, through the Department of Youth Services, or another source, for funding as proposed for the 1999 -2000 fiscal year and entry by those parties of a Contract for Truancy Prosecution for the Sixth Judicial District. 4. In the event the grant proposal is not funded or is terminated prior to the date anticipated by the parties, the undersigned agree to meet within ten (10) days of notice of such an event to determine a new method to pursue these prosecutions and /or the court(s) to be used for such prosecutions in accordance with provisions of Act 1308 of 1997.
