WHEREAS, Little Rock Resolution (ILRRO) No. 8,269 (February 28, 1990) authorized a franchise agreement with Spaghetti Warehouse, Inc, for use of the right -of -way described in Section 2 herein, for renovation of the former Choctaw Railroad Station as a restaurant facility; and WHEREAS, LRR No. .8,341 (August 7, 1990) amended LRR 8,269 to authorized the use of the franchised area to satisfy the franchisee's parking and landscaping requirements; and WHEREAS, pursuant to its franchise, Spaghetti Warehouse opened and operated a restaurant and used the franchised area until it recently closed; and WHEREAS, the principals of Spaghetti Warehouse, Inc. have reached an agreement with Dennis Martindill and Danny Martindill for their purchase of the building and grounds at 1010 West 3rd Street; and WHEREAS,, the purchasers have requested that the City approve a franchise for their use of the same area that was previously franchised to Spaghetti Warehouse, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. A franchise is hereby granted to Dennis Martindill and Danny Martindill to use a portion of Mclean and East 3rd Street for continuation of business activity within the area previously franchised to Spaghetti Warehouse, Inc. SECTION 2. The franchise is legally described as follows: Part of McLean Street, more particularly described as: Beginning at the NE Corner of Block 9, Russell's Addition, thence S 88 °341E, along the north line of said Block 9, extended 25.42" to a point which is 5.00 west of the centerline of the railroad track; thence S 1 024' W along a line which is 5.0 ° west of and parallel to said centerline of track 304.0° to a z 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 point on the north R/W of East Third Street Extended; thence N 880341 W along the north R/W of East Third Street Extended 18.0 feet to the SE Corner of Block 3, Rectortown to the City of Little Rock, Arkansasi thence north along the east line of said Block 3, Rectortown and the East line of Block 9, Russell's Addition 304.30 to the point of beginning, containing 6600.93 square feet, more or less. Part of East ibed Third Street, more particularly descr as: Parcel "A" - Beginning at the SW Corner of Block 3 Rectortown to the City of Little Rock, Arkansas; thence south along the east line of Byrd Street 13.50; thence S 880341E parallel to and 13.5° south of the north line of East Third Street 300.0 feet to the east line of McLean Street; thence north 13.5 feet to the SE Corner of said Block 3; thence N 880341 W along the north line of East Third Street 300.0 feet to the point of beginning containing 4,050 S.F. more or less. Parcel "B" - Beginning at the SE Corner of Block 3, Rectortown to the City of Little Rock, Arkansas; thence south along the west line of McLean Street 13.50; thence S 880341E 17.67"; thence N 10241E 13.50; thence N 880341W 18.0" to the point of beginning containing 242.2 S.F. more or less.
