WHEREAS, property owners Charles Fowler, Jerry Straessle, Dale V. Briggs, Dennis and Marsha Ad-
kins, Henry J. Goodspeed, and David L. Mosley desire to donate to the City approximately 3.0 acres
they own near the intersection of Belle Point and Pleasant Heights Drives, and
WHEREAS, this acquisition will assist the Park System to achieve the Master Parks Plan of linking
neighborhoods and having parkland available to all sections of the City to create a "City in a Park ", and
WHEREAS, the Board of Directors has determined that the acquisition of the subject property
would be beneficial to the interests and welfare of the citizens of the City, and
WHEREAS, the Little Rock Board of Directors deems it appropriate to accept the donation of 1.06
acres from JWL I Limited Partnership for park purposes of constructing and maintaining a pedestrian
and bicycle trail and for other possible future park purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
Section 1. The Board of Directors hereby authorizes the City Manager, Mayor and City Clerk to
execute any documents necessary for the City to accept the donation by the above - stated donors of 3.0
acres, more or less, located near the intersection of Belle Point and Pleasant Heights Drives, that is
indicated in Attachment A to this resolution, subject to the environmental assessment and title search.
The City agrees to pay the cost of the appraisal of the property, the environmental assessment, the
title search, and for donor's attorney fees for handling the transaction, up to a maximum of $10,000 for
all of such costs taken together as a whole.
Section 2. Upon obtaining ownership of the donated parcel, the City agrees to maintain the parcel
in such a manner that will preserve the property in its natural state in perpetuity.
Section 3. Funds for the title search, attorney fees, environmental assessment and closing costs,
in an amount not to exceed $10,000, are available through Donation Account Number 210 - 230 -A288.
Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such decla-
ration or adjudication shall not affect the remaining portions of the resolution which shall remain in
full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not
originally a part of the resolution.

Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
