HomeMy WebLinkAboutboa_06 19 1950In MINUP ES OF BOARD C1F ADJUSTMENT June 19, 1950 The Board of Adjustment met in the Mayor's Conference Room, Monday, June 19, 1950 at 2=00 P.M. with the following members presents Mr. W, H. Marak, Chairman Mr. Bruce Anderson Mr. Warren Baldwin Miss Emily Penton Docket No. 19-50 Little Rock School District, property bounded by 18th & Wright Avenue and Ringo and Cross Streets, described as hots 1,2,3,4,5,6,7,8,9 and pests of Lots 10,11,12,13,14, and 15, Block 278, Fulk's Addition; Zoned "C" Tiro--Fmily, requesting i-mivsr of front yard requirements, so as to permit construction of physical educational building. Mr. Anderson told the Board that the proposed building would set back 15' from the front property line. Mr. Baldwin mane the motion, seconded by Miss Penton, that the application be approved.. The motion carried. Docket No. 20-50 F. D. Henderson, 2307 North Beech, described as Lot 18, Block 11, Country Club Heights Addition, Zoned "A" One —Family, requesting waiver of side yard requirements so as to construct a onewfm ily home with a 10' driveway on one side. Mr. Henderson was present toerplain his application to the Board. Mr. & Mrs. Hemann were also present to protest. They had previously mailed a letter of protest to the Board. Mr. Henderson explained that at one place where a mock chimney would be, tyre would be only 21 to his side property line. The rest of the dwelling would be 3+ from the side property lira. The house is to be 38f wide. Mr. & Mrs. Hemann felt that Mr. Henderson was trying to build too large a home on the size of lot be owned. She stated that she offered to buy the Ikot from him„ Mr.,Henderson stated that he tried to buy some of her land, but she wouldn't sell it. ?drs. llmwmn stated that she later planned to add to her horse and would be from the side that would adjoin his property with the 2f and 31 side yard space. Mr. Henderson also stated that he tried to buy s©m~e additional property on the other side which belongs to Mr. Walker, but he refused to Bell any of it. After some discussion among the Board members,, a motion was made by Mr. Anderson to postpone the decision until July 17, the date of the next hearing, as they felt the two parties might work something out agreeable to both b* that time. The motion was seconded by Mr. Baldwin. The motion carried. -2- 21-50 Dr. C. B. Dickinson, property situated at West side of Isard Street between 3rd and 4th Streets, described as the East 75' of Lot 9, Block 253, Original City, Zoned "D" Apartment,, requesting waiver of lot area and yard requirements so as to permit construction of a duplex. Dr. Dickinson, Mr. Ferrell, Architect, anti. Mr. Cohen, Realtor, were all present to explain the application. Mr. Baldwin asked when the property was purchased and Ur. Dickinson stated �uat recently". The lot is 501 x 711. Dr. Dickinson stated the upstairs would be a duplex and he intended to use the downstairs for his oPfice for the time being. The Board felt that since he had recently acquired the property, it was not a hardship. He was aware of the ordinance at the ti-e of bi..7ing the property. Mr. Fox was present to ask questions about the driveway. Be granted to know if any water would be ceasing over on his property, The driveway is to be concave; thereby putting no more water on Mr. Foxes property than he has at the present., After some di; cussion 11r. Rsx%ersar made the motion, seconded by Miss Penton, that the application be denied. The motion carried. Those representing the petition did not feel this a justly decision, and fuxther stated that they would take the case to Chancery Court, Docket No* 23-50 Paul_ I!, S1 ikes, 7016 Rockwood Road, described as Lot 272, Kiiagwood is Add_" on, Zoned "A" One -Family; requesting waiver of side yard space requirements so as to pernit construction of home. There was no one present on this application, bvt the facts are that the property was outside the city limits, with the Bill of Assurance stating that the side yard req iremants were 7' f , but lacer t akm in the City L3;.;_its, which re-quired 89. side., ynrd space by the City Ordinance. Mr. Marak explained that leCally sae would have to wait until the ten days advertising was up before diving final approval of this application,, but if there were no objectors at the end of this tirie, June 26, the applieatien would be approved. Mr,. Anderson siede the notion to this effect„ seconded by Mius Penton. The motion carried The Mayor sat in on the latter part of the hearing. He sizowed the Board Members a pamphlet on the study of ?Jest I2th Street. The Mayor thinks it would be well to drew an arbitrary line 5 miles outside the city limits to prevent the alum areas. This meaning the Planning Commission and Board of Adjustment would have jurisdiction over the building conditions 5 miles outside the city limits. Miss Penton was welcosmed to the Board.
