June 19, 1950
The Board of adjustment met in the Mayor's Conference Room, Monday,
Jane 19, 1950 at 2:00 P.M. with the following members present:
1Ir. IJ. H. Marak, Chairman Mr. Bruce Anderson
Air. Warren Baldwin Miss Emily Penton
Docket No. 19-50 Little Rock School District, property bounded by
18th & Uri-;ht Avenue and Ingo and Cross Streets, described as Lots
1,2,3,4,5,6,7,8,9 and parts of Lots 10,11,12,13,14, and 15, Block 278,
Fulk's Addition; Zoned "C" Two -Family, requesting waiver of front yard
requirements, so as to permit construction of physical educational building.
Mr. Anderson told the Board that the proposed buildin£-, would set back 151
from the front property line.
Mr. Baldwin made the motion, seconded by Miss Penton, that the application
be approved. mhe notion carried.
Docket No. 20-50 r. ;). Henderson, 2307 North (leech, described as Lot 181
Block 11, Country Club 1'eihhts Addition, Zoned "A" One-Far..iily, requesting
waiver of side yard requirements so as to construct a one -family home with
a 101 driveway on one side.
Mr. Henderson was present to explain his application to the Board. Air. &Airs.
Hemann were also present to protest. TY,eJ had previously mailed a letter
of protest to the Board.
Mr. Henderson explained that at one place where a pock chimney would be,
there wo,-ld be only 21 to his side property line. The rest of the dwelling
would be 31 from the side property line. The house is to be 381 wide.
Mr. & Mrs. Hemann felt that Mr. Henderson was trying to build too lar;;e
a home on the size of lot he owned. She stated that she offered to buy
the lot from him. Mr.,Henderson stated that he tried to buy some of her
land, but she Wouldn't sell it. Mrs. Hemann stated that she later planned
to add to her home and would be from the side that would adjoin his property
with the 21 and 31 side yard space. Mr. Henderson also stated that he tried
to buy some additional property on the other side which belongs to 11r. Walker,
but he refused to sell any of. it.
After some discassion among the Board members, a motion was made by I,1r. Anderson
to postpone the decision until July 17, the date of the next hearing, as they
felt the two parties might work something out agreeable to both b_r that time.
The motion was seconded by Mr. Baldwin. The motion carried.

21-50 Dr. C. B. Dickinson, property situated at 'Jest side of Izard
Street between 3rd and /+th Streets, described as the East 75' of Lot 9,
Block 253, Ori;-inal City, 'Zoned "D" Apartment, request=ng waiver of
lot area and yard requirements so as to permit construction of a duplex.
Dr. Dickinson, My rr. Ferrell, Architect, and 'Ir. Cohen, Realtor, were all
present to explain the application. 11r. Baldi-rin asked when the property
was purchased and Ur. Dickinson stated lust recently". The lot is 50t x
7.51. Dr. Dickinson stated the upstairs would be a duplex and he intended
to use the downstairs for his office for the tine being.
The Board felt that since he had recently acquired the property, it was
not a hardship. IIe was aware of the ordinance at the ti-..e of buying the
property.
Mr. Fox was present to ask questions about the driveway. He wanted to
know if any water would be coming over on his property. The driveway
is to be concave; thereby putting no more water on Mr. Fox's property
than he has at the present.
after some discussion, Mr. Anderson made the *,potion, seconded by
T'Iiss Penton, that the application be denied. The motion carried. T?=ose
representing the petition did not feel this a justly decision, and further
stated that they would take the case to Chancery Court.
Docket No. 23-50 Paul IT. Spikes, 7016 Rockwood "oad, described as
Lot 272, Kingwood '!I Ac7 di ti or_, Zoned 11,111 One -Family; requesting waiver of
side yard space reryuire„ents so as to permit construction of home.
There was no one present on t'-is application, but the facts are that
the property was outside the city limits, with the Bill of Assurance
stating that the side yard requirements were 7';', but later taken in
the City Li-,'.ts, which required 8' side yard space by the City Ordinance.
Mr. Barak explained that legally we would have to trait until the ten days
advertising was up before giving final approval of t',is application, but
if there were no objectors at the end of this time, June 26, the application
would be approved. Mr. Anderson made the motion to this effect, seconded
by Miss Penton. The motion carried.
The ?Mayor sat in on the latter part of the hem ri ng . Iie showed. t'_ee Board
11--rabers a pamphlet on the study of '.!est 12th Street. The Mayor things
it would be well to draw an arbitrary line 5 miles outside the city limits
to prevent the slum areas. This meaning the Planrinm Commission and Board
of Adjustment would have jurisdiction over the building conditions 5 miles
outside the city limits.
Miss Penton was welcomed to the Board. She stated she was glad to be with
them.
The meeting was then adjourned.
