HomeMy WebLinkAboutboa_04 24 1950MINUTES OF BOARD OF ADJUSTMENT April 24, 1950 The Board of Adjustment met in the Mayor's Council Room, Monday, April 24, 1950 at 2:00 P.M. with the following members present: Mr. W. H. Marak Mr. Bruce Anderson Mr. [Marren Baldwin Mr. Marion Butz, Acting Director The first application was Docket No. 14.-50, V.O. Purvis, Jr., Chairman of Building Commission, Dmanuel Baptist Church, 1000 Bishop Street, described as Lots 1,2,3,9,10,11,12 and North 501 of 6, Block 3, Fausts Add'tion, Zoned "C" Two -Family; requesting waiver of front, side and rear yard regi.irements. Mr. Purvis, Mr. R. L. Burton, and Mr. Hammett were present to represent the application. Mrs. Fairchild was present to object to the closeness of the front property set back which was about 21. The men representing the appli- cation told Mrs. Fairchild they could not set back any further as they were already cramped for room. Mr. t•tarak stated that the Board had been generous in the past on church applications and didn't see how they could refuse this one. The part of the church that would be close to the front property line is just an entrance way. It would also.be on the North side and would not cut off any sunlight from firs. Fairchild. Mr. Baldwin made the motion, seconded by Per. Marak, that the application be approved. The motion carried. The next application was Pocket No. 15-50, Jack Kavanaugh, property situated at West Side of Wildwood Woad between Ed ewood and lint,, described as Lots 231-235 inclusive & Outlot ",", Zoned "A" One -Family in Prospect Terrace ''3 Addition: requesting variation from the front set back provisions and the side yard space requirements. Mr. Kavanaugh and three-' prospective buyers were present at the meeting. The names of the prospective buyers are: Mr. Benton, Mr. Albert Bergs, Jr., Mr. Burford, and Mr. flood. All were present except 1v1r. Wood. Mr. Beggs, Jr. told the Board that they wished to set back 201 from the front property line and also have a waiver of side yard space. The 201 set back is in keeping with the Bill of Assurance. He told the Board that they had talked with the previous objectors who have now withdrawn their objections after learning the facts. It was first rumored that they were building the houses to sell, but the fact is they are planning to live in them themselves. Sketches were shown and it appears that very nice homes are to be built on the lots. It was brought out if the petition were denied, someone else col..ild build on the lots and set back 25', but they would also b.:ild a-,5,000 home, which would not be very much at the present time. All felt it better to have nice homes there and grant a waiver of 51 front property set back. No objectors were present. Mr. Baldwin made a motion, seconded by 1.1r. Anderson, that the apnli cation be approved on condition the improvements be constructed as homes for the applicants. The motion carried. The meeting was then adjourned. Marion F.
