BOARD OF ADJUSTM
March 20, 1950
The Board of Adjustment stet in the Council Chamber, Monday, March 20, 1950
at 2:00 P.M. with the following nembers present:
Mr. Marak, Chairman Mr. Louis Tarlowski
Mr. Warren Baldwin Mr, Marion Butzs
Mr. Bruce Anderson Acting Director
Docket No. 7-50 Ralph Mase, 2315 North Polk Street; the West 1001 of
Lot 8s Block 6, Newtons Additions Zoned "A* 0ne-Family; requesting waiver
of front yard space requirements, so as to permit construction of a one -
family residence.
There was no one present to represent this petition.
Mr. Anderson made the motions seconded by Mr. 'Tarlowski,, that the application
be approved. The motion carried.
Docket No. 8-50 Jack Kavanaugh Company, Agentss crest Side of Wildwood
Road between E'dlewood Road and "0" Streets described as Lots 231-235 inclusive
and Outlot "B", Prospect Terrace �3 Additions Zoned "A" One -Family; requesting
waiver of front yard set back restrictions on Wildwood Road and side yard
set back restrictions on "0" Street.
Mr. Marak told persons present that there had been two letters of objection
filed with the Planning Director. He then read them to the Board. They were
from Air. & Mrs. Donald B. Tobey and R. L. Baird.
Mr. Kavanaugh then told the Board that the property in question was to be
'wilt on by lair. Burton, Mr. Benton, and Mr. bloods if the application was
granted. He stated because of the slope of the land it would create a
hardship and increase expenses to set back 25' from the }ftpdrty line. The
Bill of Assurance reads that the building line is 202 from the property line.
They wished to waiver this 519 thus building back 15' from the front property
line.
Mr. Kahn, ealtor, was present to strongly object. He stated that to build
in this -anner would decrease the value of their property. He told the Board
that he had been the allotter for Prospect Terrace Addition and had assured
the buyers that they would be protected by the Bill of Assurance. He stated
that Mr. Jacoway had himself stressed that monetary considerat:1on was not a
good reason for waiving of existing restrictions. Mr. Kahn said that they
could build two stories, with the first floor down on the slope and then bring
the second floor up.
Mr. Fallingely, also an objectors explained that it would take the signatures
of 60% of the property owners to get permission to build back from any other
set back than that given in the Bill of Assurance. Since this was necessary,
hte felt that it was useless to take up the Board's time and the tame &' the
people present. The Chairman then asked all objecting the application to stand.
There were 13 present who objected to the petition..

Mr. Kavanaugh told the Board that he felt it better to build these houses
by waiving the property building line than to sell them to someone who
would build a cheap home on them. The Bill of Assurance reads that a
home built in this addition is not to cost less than $5,000.00.
One lady objector present then spoke and said that a committee was working
on getting this changed in the Bill of Assurance as a $5,000.00 home in
this day is nothing compared to the time the Bill of Assurance was written.
Mr. Baldwin then pointed out that the property was bought with the idea
of complying with the Bill of Assurance. Mr. Baldwin made the motion,
seconded by Mr. Tarlowski, that the application be denied. The motion
carried.
Rocket No. 10-50 Wm. A. Taylor, 2601 West 5th Street, described as the
North 781 of Lot 1, Block 2, Ferndale Addition! Zoned "B" Residence,
requesting waiver of front yard space requirements. This 501 x 78, lot
was platted before the passage of this ordinance,
Mr. Taylor was present and told the Board that he would like to construct
a one —family residence on his small lot, but it would be necessary to
have front yard space waivered. There were no objectors present.
Mr, Tarlowski made the motion, seconded by Mr. Anderson, that the applica—
tion be approved. The motion carried.
Rocket No. 11-50 Paul B. Spikes, Northeast corner of 29th & Taylor,
described as the ?Vest 501 of Lots 7,8, and 9. Block 2, C. 0. Brack Addition,
Zoned "B" Residence, requesting waiver of side yard space requirements.
Mr. Spikes was present and told the Board that this was a side yard waiver
on a reverse corner lot which required that the side yard be 50% of the
front yard of the lot which this lot backs up to. There were no objectors,
Mr. Baldwin made the motion, seconded by lax•. Anderson, that the application
be ar�3roved. The motion carried.
Docket No. 12-50 Frank L, Adams, 2316 North Harrison, Lot 8, Block 5,
Newton's Addition, Zoned "A" One —Family, requesting waiver of side yard
space requirements to permit construction of a one family residence,
Mr. P.tfrs. Adams were present, but there were no objectors present. iIr. Marak
told Mr. ec"Mrs. Adams that legally we would have to wait until the ten days
advertising was up before giving final approval of this application, but if
at the end of the ten days, March 23, there still were no objectors, the
application would be approved. This was put in the form of a notion by
Mr. Baldwin, seconded by Mr. Tarlowski. The motion carried.
Docket No. 13-50 A. B. Corder, 1920 North Orent, Lots 1 and 2, Block 8,
Motultain Park Addition, Zoned "F" Commercial, requesting waiver of yard
space requirements.

This property was previously granted front yard waiver and permission to
reverse lots This is to permit construction of a Super Market with
Off—street parking provided.
Mr. Corder was present and told the Board that through an error they had
only asked for a waiver of front yard space on the previous application.
The lots are next to a residence lot which in zoned also for OF" Commercial.
Mr. Crouch is the owner of the lot and lives in the house erected thereon.
Mr. Orouch stated that he had no objections to the application if the
parking area was to be next to his resideanee. Mr. Corder assured him that
this was the case. He showed the Board his plans to verify this.
Mr. Marak then explained to Mr. Carder that legally we would have to wait
until the ten days advertising was up before giving final approval of this
application,q but if there were no objectors at the end of this tines March 30s
the application would be approved. This was put in the form of a notion by
Mr. Anderson# seconded by Mr. Tarlowski. The motion carried.
The meeting was there adjourned.
