15129 1 RESOLUTION NO. 15,129 2 3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO. 4 15,036(AUGUST 6,2019),TO AUTHORIZE A 20%CONTINGENCY RATE 5 TO THE CONTRACT WITH TOWNSHIP BUILDERS, INC., TO 6 RESURFACE WALKING TRAILS AND TO IMPROVE ADA 7 ACCESSIBILITY AT THE LITTLE ROCK ZOO; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS, in Little Rock, Ark., Resolution No. 15,036 (August 6, 2019), the Board of Directors 11 authorized the Little Rock Zoo to contract with Township Builders,Inc,to upgrade,resurface and redesign 12 areas of the walking trails and pathways, including ADA improvements to insure walking trails and paths 13 are accessible to all Zoo guests and to improve the overall experience for Zoo visitors;and, 14 WHEREAS, the Little Rock Zoo requests the standard 20% contingency rate of One Hundred Fifty- 15 Nine Thousand,Two Hundred Eighty Dollars($159,280.00)be added the contract with Township Builders, 16 Inc.; and, 17 WHEREAS,the total amount of the project was Seven Hundred Ninety-Six Thousand, Four Hundred 18 Dollars ($796,400.00), and funding is provided by the Arkansas Department of Transportation's 19 Transportation Alternatives Grant, with matching funds from the City of Little Rock, Arkansas ("City"); 20 and, 21 WHEREAS, the added 20% contingency rate of One Hundred Fifty-Nine Thousand, Two Hundred 22 Eighty Dollars($159,280.00) is available from Account No.326659-72504-TS65A32, and the project will 23 be funded as follows: Three Hundred Eighty-Four Thousand Dollars ($384,000.00) from the Zoo Trails 24 Grant, Account No. 270659-72504-G235128; Ninety-Six Thousand Dollars ($96,000.00) from the Zoo 25 Trails Grant Match, Account No. 108659-72504-$65G106; and Three Hundred Sixteen Thousand, Four 26 Hundred Dollars ($316,400.00) from the''/a-Cent Capital Improvement Sales and Compensating Use Tax 27 Fund for Zoo Improvements,Account No. 326659-72504-TS65A32. 28 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 29 OF LITTLE ROCK,ARKANSAS: 30 Section 1. The City Manager is authorized to include a 20%contingency rate of One Hundred Fifty- 31 Nine Thousand, Two Hundred Eighty Dollars ($159,280.00) to the project with Township Builders 32 approved in Little Rock, Ark. Resolution No. 15,036 (August 6, 2019) in an amount not to exceed Seven 33 Hundred Ninety-Six Thousand, Four Hundred Dollars ($796,400.00) to provide General Construction [Page I of 21 I Services to the Little Rock Zoo for construction upgrades to resurface and redesign areas of the walking 2 trails and pathways, including ADA improvements to insure walking trails and paths are accessible to all 3 Zoo guests. 4 Section 2. The 20%contingency of One Hundred Fifty-Nine Thousand,Two Hundred Eighty Dollars 5 ($159,280.00) will be funded from Account 326659-72504-TS65A32 and the project will be funded as 6 follows: Three Hundred Eighty-Four Thousand Dollars($384,000.00)from the Zoo Trails Grant,Account 7 No.270659-72504-G235128;Ninety-Six Thousand Dollars($96,000.00)from the Zoo Trails Grant Match, 8 Account No. 108659-72504-5650106; and Three Hundred Sixteen Thousand, Four Hundred Dollars 9 ($316,400.00)from the'A-Cent Capital Improvement Sales and Compensating Use Tax Fund for Zoo Im- 10 provements,Account No. 326659-72504-TS65A32. I l Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 12 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 13 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 14 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 15 resolution. 16 Section 4. Repealer.
