15031 1 RESOLUTION NO. 15,031 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR TO ACCEPT FOR 4 MUNICIPAL PURPOSES, PERMANENT CONSTRUCTION 5 EASEMENTS, RIGHT-OF-WAY DEDICATIONS AND FEE SIMPLE 6 ACQUISITIONS, AND THE CITY MANAGER TO ACQUIRE 7 TEMPORARY CONSTRUCTION EASEMENTS AS NEEDED TO 8 COMPLETE THE CONSTRUCTION OF THE 2019 - 2021 STREET AND 9 DRAINAGE CAPITAL IMPROVEMENT PROGRAM; AND FOR OTHER 10 PURPOSES. 11 12 WHEREAS, the Public Works Department has initiated a Capital Improvement Program funded by 13 the 3/8-Cent Capital Improvement Sales and Compensating Use Tax and the 2018 Capital Improvement 14 Bonds for Streets and Drainage; and, 15 WHEREAS,the acquisition of easements is needed to accomplish the construction, maintenance and 16 continued access of street and drainage improvements. 17 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 18 OF LITTLE ROCK,ARKANSAS: 19 Section 1. The City Manager is authorized to pursue the acquisition of Permanent Construction 20 Easements, Right-of-Way Dedications, Fee Simple Acquisitions and Temporary Construction Easements 21 as need to complete the projects identified in Resolution No. 14,803 (June 19, 2018). 22 Section 2. The Mayor is authorized to accept Permanent Construction Easements, Right-of-Way 23 Dedications,Fee Simple Acquisitions for municipal purposes and the City Manager is authorized to accept 24 Temporary Easements needed for construction. 25 Section 3. Funding for acquisition of easements and dedications is from the amounts allocated to each 26 Ward for the projects. 27 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 31 resolution. 32 Section 5. Repealer.All laws, ordinances, resolutions,or parts of the same, that are inconsistent with 33 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
