4 NEARING ON THE APPEAL OF THE PLANNING COMMISSION'S
5 DENIAL OF A PLANNED ZONING DEVELOPMENT, TITLED 8409
6 GEYER SPRINGS ROAD SHORT-FORM PCD (Z-4093-A), LOCATED AT
7 8409 GEYER SPRINGS ROAD, LITTLE ROCK, ARKANSAS; AND FOR
8 OTHER PURPOSES.

10 WHEREAS, an application to rezone property located at 8409 Geyer Springs Road from 0-3,
11 General Office District, to PCD, Planned Commercial Development, filed by Ms. Margarita Gutierrez,
12 was denied on January 11,2018, by the Little Rock Planning Commission by a vote of a five(5)ayes and
13 six(6)nays; and
14 WHEREAS, the applicant timely filed an appeal of this decision to the Little Rock Board of
15 Directors;
16 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK,ARKANSAS.
18 Section 1. A public hearing shall be held on Tuesday, March 20, 2018, at 6:00 PM, or as soon
19 afterwards as the item is reached upon the call of the Agenda, in the Board Chambers on the second floor
20 of City Hall, 500 West Markham Street, Little Rock, Arkansas, on the question of whether to overturn the
21 denial by the Little Rock Planning Commission of a request by Ms. Margarita Gutierrez to rezone the
22 property located at 8409 Geyer Springs Road from 0-3, General Office District, to PCD, Planned
23 Commercial Development.
24 Section 2. The City Clerk is hereby directed to give notice of such hearing in the manner prescribed
25 by law by publication once a week for two (2) consecutive weeks in a newspaper published in Pulaski
26 County,Arkansas,and having a general circulation in the City of Little Rock.
27 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
31 resolution.
32 Section 4.Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
33 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
