14013 1 RESOLUTION NO. 14,013 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH DAYCO CONSTRUCTION, INC., FOR THE 5 CONSTRUCTION OF THE ARKANSAS HERITAGE FARM PROJECT; 6 AND FOR OTHER PURPOSES. 7 8 WHEREAS, the Little Rock Zoo conducted a public meeting, publicized through press releases and 9 an advertisement in the newspaper, to obtain public input into in a new project for the Zoo, with the result 10 that an Arkansas Heritage Farm Project was chosen to be constructed; and, 11 WHEREAS, the City was subsequently awarded a National Parks Service Grant for partial funding 12 for the construction of the Arkansas Heritage Farm Project; and, 13 WHEREAS, after proceeding with the competitive bidding process, it was determined that Dayco 14 Construction, Inc., was the low bidder for the construction of the Arkansas Heritage Farm Project, in the 15 amount of Seven Hundred-Fifty Six Thousand Dollars($756,000.00); 16 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK,ARKANSAS: 18 Section 1. The Board of Directors hereby awards a contract to Dayco Construction, Inc., to construct 19 the Arkansas Heritage Farm Project for the Little Rock Zoo for a total contract amount not to exceed 20 Seven Hundred Fifty-Six Thousand Dollars ($756,000.00), plus 20% to allow change orders, if needed, 21 for a total amount of Nine Hundred and Seven Thousand, Two Hundred Dollars ($907,200.00), but with 22 the understanding that any expenditures for the project beyond the bid amount of Seven Hundred Fifty- 23 Six Thousand Dollars ($756,000.00) shall be funded through private or grant contributions and not 24 through City funds. The City Manager is authorized to enter into a contract with this condition, in a form 25 acceptable to the City Attorney. 26 Section 2. The funds for the contract as to the bid amount are to come from the Zoo's capital AU 27 32659 account and National Parks Grant funding in account AU 270659. 28 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju- 30 dication shall not affect the remaining portions of the resolution, which shall remain in full force and ef- 31 fect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 32 resolution. 33 Section 4.Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this res- 34 olution are hereby repealed to the extent of such inconsistency.
