3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH JAMES A. ROGERS EXCAVATING CO.,
5 INC., IN THE AMOUNT OF $3,394,958.42, FOR SCOTT HAMILTON
6 STREET AND DRAINAGE IMPROVEMENTS FROM 65TH STREET TO
7 INTERSTATE 30; AND FOR OTHER PURPOSES.

9 WHEREAS,Bids were solicited for street and drainage improvements to Scott Hamilton Street Road
10 from 65th Street to Interstate 30, Bid No. 14122.
11 AND, James A. Rogers Excavating Co., Inc., was the lowest responsive, responsible bid meeting
12 specifications in the amount of Three Million, Three Hundred Ninety-Four Thousand, One Hundred
13 Thirty-Two and 42/100 Dollars ($3,394,958.42); Two Million, Eight Hundred Twenty-Nine Thousand,
14 One Hundred Thirty-Two and 02/100 Dollars($2,829,132.02)plus 20%contingencies.
15 NOW, THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK,ARKANSAS:
17 SECTION 1. The City Manager is hereby authorized to execute an agreement with James A. Rogers
18 Excavating Co., Inc., for the Scott Hamilton Street and Drain Improvement Project in the amount of
19 Three Million, Three Hundred Ninety-Four Thousand, One Hundred Thirty-Two and 42/100 Dollars
20 ($3,394,958.42); Two Million, Eight Hundred Twenty-Nine Thousand, One Hundred Thirty-Two and
21 02/100 Dollars ($2,829,132.02)plus 20%contingencies.
22 SECTION 2. Funding for this project is available from the 2013 Capital Improvement Bonds for
23 Streets and Drainage.
24 SECTION 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
25 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
26 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
27 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
28 resolution.
29 SECTION 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
30 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
31 SECTION 5. This resolution will be in full force and effect from and after the date of its adoption.
